Access and Use Restrictions

You are prohibited from allowing unauthorized third parties to access or use the Hosting Services. However, if you have purchased one of our reseller hosting packages, you may grant access to third parties (referred to as "Third Parties"). If you do so, these Third Parties are also bound by this Acceptable Use Policy, and you must ensure their compliance. Any violation of this AUP by a Third Party will be considered a violation by you.

The Hosting Services are provided by Webz Fusion (“we”, “us”, and “our”). Webz Fusion is a company registered in Singapore under registration number 53418515X, with its registered office at 60 Paya Lebar Road, #07-54 Paya Lebar Square, Singapore 409051.

A. RESOURCE USAGE

1. The Shared Hosting Services involve providing web space on our servers, allowing you to upload files and pages for the purpose of publishing websites.
2. The Shared Hosting Services allow ‘unlimited’ server space for typical non-file-distribution web usage. We reserve the right to impose a bandwidth limit of 250 gigabytes per calendar month for websites that permit the downloading of video, audio, or other files.
3. Non-file-distribution usage will not be affected by any imposed limits on downloading video, audio, or other files.
4. You must not use more than 10% of our platform's processing capacity. Activities that may cause such problems include (but are not limited to) CGI scripts, intensive FTP, PHP, or HTTP operations.Running stand-alone, unattended server-side processes or any daemons (e.g., IRCd) is prohibited.
   
   

• Running any type of web spider or indexer is prohibited.
• Running any software that interfaces with an Internet Relay Chat (IRC) network is prohibited.
• Running bit torrent applications, trackers, or clients is prohibited. You may link to legal torrent files off-site but may not host or store them on our servers.
• Participation in any file-sharing or peer-to-peer activities is prohibited.
• Running gaming servers is prohibited.
• Running entries or other scheduled tasks other than by configuring them through our control panel is prohibited.
• Giving away web space under a domain (including resellers giving away free websites) is prohibited.
• Operating a proxy website or service is prohibited.
• Using hosting services as a remote file host for other websites is prohibited.
• Operating self-hosted file sync or similar “cloud storage” services (e.g., OwnCloud, Pydio, Sparkleshare) is prohibited.
  
  

5. You must not use the Hosting Services as an offsite backup facility. All files uploaded to our servers must be visible and accessible to the outside world (web-visible) unless required to operate the website of which they are part. We reserve the right to delete non-web-visible files or directories without notice.

6. All web pages stored on our servers will be available to search engines unless you take action to prevent this. If you optimize your web pages for search engines, you agree to use techniques that comply with the guidelines issued by major search engines like Google, Bing, and Yahoo.

7. MySQL databases are limited to 1024 megabytes. We will notify you if they reach this size.

8. If you are a reseller and deactivate a resold web hosting account, it will be deleted after 30 days.

B. PROHIBITED USES

1. You may use the Hosting Services only for lawful purposes. You must not:
   
   

• Use the services in any way that breaches applicable local, national, or international law or regulation.
• Use the services unlawfully or fraudulently or for any purpose with such intent.
• Use the services to harm or attempt to harm minors in any way.
• Use the services to send, receive, upload, download, or reuse any material that does not comply with our content standards.
• Transmit unsolicited or unauthorized advertising or promotional materials (e.g., SPAM).
• Transmit any data or upload material containing viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or other harmful programs or code designed to affect computer software or hardware negatively.
  
  

C. CONTENT STANDARDS

1. These content standards apply to all materials you allow to be hosted through the Hosting Services and to any interactive services associated with it.
2. You must comply with the spirit of these standards, which apply to each part of any material as well as to its entirety.
3. Material must:
   
   

• Be accurate (where it states facts).
• Be genuinely held (where it states opinions).
• Comply with applicable laws in Singapore and in any country from which they are posted.
  
  

4. Material must not:

• Contain defamatory content about any person.
• Contain obscene, offensive, hateful, or inflammatory content.
• Contain pornographic content.
• Promote violence.
• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Infringe any copyright, database right, or trademark of any person.
• Be likely to deceive any person.
• Be made in breach of any legal duty owed to a third party (e.g., contractual duty, duty of confidence).
• Promote any illegal activity.
• Be threatening, abusive, or invade another’s privacy, or cause annoyance, inconvenience, or unnecessary anxiety.
• Be likely to harass, upset, embarrass, alarm, or annoy any person.
• Impersonate any person or misrepresent your identity or affiliation with any person.
• Give the impression that they emanate from Webz Fusion if this is not the case.
• Advocate, promote, or assist any unlawful act (e.g., copyright infringement, computer misuse).
  
  

D. ZERO TOLERANCE SPAM POLICY

1. Webz Fusion enforces a zero tolerance stance against sending unsolicited email, bulk emailing, and spam. We may terminate the account of any user found sending spam without notice.
2. Websites advertised via spam are prohibited from being hosted on our servers. This includes spam sent via fax, phone, postal mail, email, instant messaging, or newsgroups. Accounts resulting in our IP space being blacklisted will be suspended and/or terminated immediately.
3. Webz Fusion reserves the right to require changes or disable any website, account, database, or component that does not comply with our policy.
4. Webz Fusion reserves the right to charge the account holder responsible for sending unsolicited emails a clean-up fee or any charges incurred for blacklist removal at our sole discretion.
   
   

E. RESELLING

1. You agree not to:
   
   

• Resell or offer any part of our Hosting Services to third parties unless you have purchased a specific reseller product.
• Access, interfere with, damage, or disrupt any part of the Hosting Services, any equipment or network used to provide the Hosting Services, any software used in the provision of the Hosting Services, or any equipment, network, or software owned or used by any third party.
  
  

2. If you deactivate a resold Hosting Service for 30 consecutive days, we will automatically delete this Hosting Service.

3. You are responsible for maintaining good housekeeping of your Reseller Service. You agree to delete files and Hosting Services that are no longer required.

F. SUSPENSION AND TERMINATION

1. We will determine, at our discretion, whether there has been a breach of this Acceptable Use Policy through your use of the Hosting Services. If a breach has occurred, we may take appropriate action, including but not limited to:

• Immediate, temporary, or permanent withdrawal of your right to use the Hosting Services.
• Immediate, temporary, or permanent removal of any material uploaded to our servers.
• Issuing a warning to you.
• Legal proceedings against you for reimbursement of all costs on an indemnity basis (including administrative and legal costs) resulting from the breach.
• Further legal action against you.
• Disclosure of such information to law enforcement authorities as we deem necessary.
  
  

G. CHANGES TO OUR ACCEPTABLE USE POLICY

Webz Fusion may revise this Acceptable Use Policy at any time by amending this page. You are expected to check this page periodically to take notice of any changes we make, as they are legally binding on you.
